Terms & Conditions of Business


The purpose of these General Terms and Conditions is to define the rights and obligations of the parties in the context of the rental of camping pitches and/or rental accommodation at our campsite.

By reserving a pitch and/or accommodation at our campsite, you acknowledge that you have read and accepted these terms and conditions.



1/ Services - Prices



We offer bare pitches and rental accommodation for hire.



Bare pitch
This is a bare pitch for your tent, caravan or camper van.

The price of your stay is calculated on the basis of a package that necessarily includes the rental of the pitch, the possibility for 2 people to stay there, the possibility of pitching 1 tent with 1 vehicle, OR 1 caravan with an extra vehicle OR 1 camper van; and access to reception facilities, entertainment and sanitary facilities and, depending on the package chosen, a connection to the electricity network, or other options.



You must select one of the following packages:

Comfort package: with or without electricity, pitch approx. 80m2

Privilege package: with or without electricity, pitch between 100 and 130m2 approx.
Privilege package with fridge: with electricity, fridge, pitch between 100 and 130m2 approx.

Additional costs (extra person, extra vehicle, pets, etc.) are not included in the above packages and will be added to them.



A security deposit of 100 euros will be required following your reservation (credit card imprint, bank cheque or cash) on arrival, which will be returned to you at the end of your stay when you check out. However, we reserve the right to retain all or part of the deposit in the event of damage to the pitch, damage to the fridge, if applicable, or uncollected rubbish or dog mess.



Rental accommodation
Our prices include the rental of the accommodation according to the number of people (depending on the capacity of the accommodation), water, gas and electricity charges (excluding recharging the battery of an electric or hybrid vehicle), parking for one vehicle, access to reception facilities, entertainment and sanitary facilities.

A security deposit of 580 euros will be required upon booking (credit card imprint, bank cheque or cash) on arrival, which will be returned to you at the end of your stay when you check out. However, we reserve the right to retain all or part of the deposit in the event of damage to the accommodation and/or its contents and/or equipment on the campsite.

We also reserve the right to deduct the sum of 80 euros for cleaning costs if this has not been carried out on departure.


Common provisions
The prices shown are in € and include VAT. They do not include the tourist contribution (tourist tax + eco-participation).

Whichever option you choose (bare pitch or rental accommodation), additional costs will be charged for extra people, extra vehicles, pets, visitors, etc.

Our prices may change according to economic and commercial conditions. The contractual price, payable by you, is that shown on your booking confirmation.



Flower Campings applies dynamic pricing. As a result, prices may rise or fall.

Partner advantages and promotions cannot be applied to a confirmed booking, whether it has already been paid for in full or in part; they are not retroactive under any circumstances.

It is therefore possible for customers to have paid different prices for the same holiday. Customers who have paid the highest price will under no circumstances be entitled to a refund of the difference between the price they have paid and the promotional price.



2/ Booking conditions



Booking procedure
You can make a booking on our website www.lesmijeannes.com and the website www.flowercampings.com or by telephone.

All booking requests must be accompanied by :

payment of a deposit of 30% of the total cost of your stay, including VAT, including the price of the services booked and, if applicable, the tourist contribution,
payment of the cancellation insurance premium, if applicable.


Reservations are not binding until you have received written confirmation of your booking by e-mail, summarising all the information relating to your stay.

The balance of the price of the holiday, including the price of the services booked and, if applicable, the tourist contribution, must be paid no later than 30 days before the start of the holiday. If the balance is not paid within the aforementioned period, the holiday will be considered cancelled and our cancellation conditions described below will apply.



All bookings made less than 30 days before the arrival date must be paid in full at the time of booking, unless you are informed of more favourable conditions.



No right of withdrawal
According to article L. 221-28 12° of the French Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering and leisure services that must be provided by a specific date or period.


Maximum capacity
For safety and insurance reasons, the number of occupants may not exceed the capacity specified for the type of accommodation or pitch booked (1 to 8 people maximum, depending on the capacity of the accommodation or pitch, including newborn babies). If, on your arrival, we find that the maximum capacity of the accommodation or pitch reserved has been exceeded, we reserve the right to refuse you access to the accommodation or pitch reserved, without refund of the price of your stay.



Clientele - Minors
For safety reasons, minors who are not accompanied by their parents or grandparents for the duration of their stay are not accepted on our campsite, unless authorisation is given by us prior to arrival, by e-mail, at your request.





3/ Payment methods



Accepted methods of payment
You can pay for your booking or your stay in euros using the following methods of payment:

Credit card, holiday vouchers, cash.



However, by way of exception, bookings made less than 30 days before the start of the holiday must be paid for by credit card only.


Visitors
For stays on pitches without reservation (visitors), you must pay for the night(s) required on arrival. If your stay is extended, you are also responsible for paying the balance before the rest of your stay. Please note the opening hours of reception.

No refund will be made in the event of early departure.

4/ Stay
Collection of keys
Arrivals are from 3pm and departures no later than 10am for mobile homes and 12am for pitches.

Your wishes for a specific pitch or accommodation on the campsite can only be met if we are able to accommodate you on arrival.

Any dissatisfaction concerning the state of cleanliness and/or the general condition of the accommodation or pitch must be notified in writing no later than 24 hours after arrival, so that we can rectify the situation.

No complaint will be accepted more than 24 hours after the day of arrival.

Your accommodation must be left in the same condition as when you left; in particular, you must have cleaned it yourself. If this is not the case, the campsite reserves the right to deduct the cost of cleaning from your security deposit in application of Article 1 of these GTCS.

Your pitch must be clean. The fridge must be cleaned, if you have rented one.

Late arrival and early departure
In the event of late arrival or early departure in relation to the dates stated on your booking confirmation, the full amount of your stay will be due. You will not be entitled to any refund for the part of the stay not taken.


Animals
Dogs and cats are allowed on our campsite - with the exception of category 1 'attack dogs' and category 2 'guard and defence dogs', as defined by law no. 99-5 of 6 January 1999. Dogs must be kept on a lead within the campsite grounds. Please respect the hygiene and environment of the campsite. Each animal's health record, including any passport showing proof of vaccinations, particularly rabies vaccinations, must be presented to the campsite if necessary. You must also be able to show us the animal's tattoo or microchip certificate, as well as a copy of the third-party insurance certificate.



Only dogs are allowed in mobile homes and rental accommodation, and limited to one dog per accommodation. All other animals are prohibited.



Rules and regulations
Throughout your stay, you must abide by the campsite's rules and regulations, a copy of which is displayed at reception. We will be happy to send you a copy by e-mail on request.

Image
During your stay, we may take photographs and/or make videos on the campsite for the purposes of entertainment and/or communication, on any media, in which you and the persons accompanying you are likely to appear. By making a reservation, you are deemed to authorise us to use, for a period of 5 years, the photos and/or videos in which you appear for the above-mentioned purposes. You also guarantee that this authorisation will be given by the persons accompanying you. Any specific refusal must be notified to us in writing on a durable medium.



Unavailability of certain services
The services and facilities we offer (swimming pool, restaurant, activities, entertainment, etc.) may not be available all year round, particularly for climatic reasons or in the event of force majeure, or may not operate at all times of the year. They may therefore be temporarily unavailable during all or part of your stay. The campsite will do its best to inform you of any work or improvements undertaken during your stay.



Cancellation of the booking contract in the event of a fault on your part
The booking contract will be cancelled automatically in the event of any of the following events:

- In the event of repeated non-compliance, i.e. repeated non-compliance by you and/or those accompanying you with our house rules, following a formal notice to comply sent by e-mail.

In this case, you must leave your accommodation or pitch within 2 hours of the termination of your contract, which will be notified to you by e-mail. No refund will be made,

- If you do not show up at the campsite within 24 hours of the start of your stay and do not provide proof and/or news of your arrival.

We will dispose of your accommodation at the end of the aforementioned 24-hour period if we have been unable to contact you using the contact details provided when you booked your holiday.

Where applicable, we will retain all sums paid by you; no refund will be made.


5/ Changing your holiday

You may request to change the dates and/or type of accommodation of your stay at our campsite, provided that your request is received by e-mail at least 21 days before the original date of arrival.

However, you will have to book a new stay at our campsite during the same season as the one in which the initial stay was planned, subject to availability and current prices. Your initial stay may not be changed more than once. If you are unable to honour the holiday substituted for the initial holiday, it will be considered cancelled; the sums paid will not be refunded.

If the price of the substituted holiday is higher than that of the initial holiday, you must pay the difference no later than 30 days before the new arrival date. If you fail to do so, the substituted holiday will be considered cancelled and our cancellation conditions described below will apply. If the price of the substituted holiday is lower than the price of the original holiday, we will retain the difference in price as compensation for the loss resulting from the change to the holiday.





6/ Cancellation of holiday



Cancellation by you
Any cancellation must be notified to us by any written means on a durable medium (by e-mail, registered letter with acknowledgement of receipt, etc.).

If your e-mail/courier is presented more than 30 days before your arrival, the amount of the deposit paid and, if applicable, the sums paid under the cancellation insurance will be retained by the campsite.
If your letter is presented between the 30th and 15th day before your arrival, the amount of the deposit paid at the time of booking and, if applicable, the sums paid for cancellation insurance at the time of booking will be retained by the campsite; the balance of the price of the stay will be the subject of a credit note to be used against a future stay at the campsite, which must be booked during the same season as the cancelled stay or during the following season. If you have booked your stay less than 30 days before the date of your arrival, and your letter of cancellation is presented 15 days or more before this date, the sums corresponding to the amount of the deposit and the contribution linked to any cancellation insurance taken out, as referred to in article 2 of these GTCs, will be retained by the campsite; the remainder will be the subject of a credit note to be used against a future stay at the campsite, which must be booked during the same season as the cancelled stay or during the following season.
If your letter is presented less than 15 days before the date of your arrival, all sums paid to the campsite will be forfeited.

To obtain any compensation, we advise you to take out cancellation or interruption of stay insurance at the time of booking.



Notwithstanding the above



if your cancellation is due to the fact that you live in an area where a confinement measure prohibiting people living there from moving around to prevent the spread of Covid 19 is in force on the date your stay begins, the amount of the deposit paid, the booking fees paid and, if applicable, the sums paid for cancellation insurance remain the property of the campsite; the remainder will be credited towards a future stay at the campsite, which must be booked during the same season as the cancelled stay or during the following season. This is the case even if your letter of cancellation is presented to us less than 15 days before the start date of your stay;
if your cancellation is the result of force majeure, i.e. an unforeseeable, irresistible (insurmountable) and external event (beyond your control), all the sums you have paid will be converted into a credit note for a future stay.


Cancellation by the campsite
If we are forced to cancel a booking that we have confirmed to you, we will notify you by e-mail as soon as possible. The sums paid will be reimbursed in full within 10 days of notification of cancellation.



7/ Complaints - Disputes
In the event of a dispute and if no amicable solution is found within one month of receipt of the above-mentioned letter of complaint, you may have free recourse to a consumer ombudsman, provided that you refer the matter to him within one year of sending your letter of complaint.

8/ Customer reviews

All customer reviews are taken into account in chronological order. A response is given systematically and as quickly as possible. Reviews that are unfounded, unjustified or of a personal nature may be suspended. The reasons for this withdrawal will be explained to the customer.

No compensation is provided in exchange for submitting a review. There is no maximum publication or retention period. However, at the customer's request, we will remove this notice.



9/ Personal data

When you make a reservation or during your stay, some of your personal data may be collected and processed by us.

When a booking is made via our website or via www.flowercampings.com, the methods of processing the data collected prior to or at the same time as the booking are set out in the confidentiality policy or the general terms and conditions of sale that you accept before confirming your booking.

The personal data collected when you make a reservation by telephone or during your stay is as follows:

- Surname and first name of the person who made the reservation,

- Telephone number of the person who made the reservation,

- Email address of the person who made the reservation

- Date of birth of the person who made the booking and of accompanying persons.

This data is collected and processed on the following basis:

- Your consent,

- The need to enable the performance of a booking contract entered into between us.

No-one other than us and Flower (a simplified joint stock company with capital of €92,500, registered with the Toulouse Trade and Companies Register under no. 492 355 508, with its registered office at Les Espaces de Balma 4-5, 16 avenue Charles de Gaulle, 31130 BALMA) has access to the data collected.

The data collected is processed for the following purposes:

- The performance of a booking contract concluded between us;

- Managing any complaints you may have;

- Keeping our customer file;

- Carrying out commercial canvassing by us and/or Flower;

- To manage our accounts.

The data collected is kept for as long as is necessary to execute the booking contract and will be kept for 5 years after the end date of the stay, except in the event of a dispute that has not been settled by the end of this period, in which case the data will be kept until the dispute has been settled.

In accordance with the French Data Protection Act no. 78-17 of 6 January 1978, it is specified that each person has the following rights with regard to their data: right of access, right of rectification, right to erasure (right to be forgotten), right of opposition, right to limitation of processing, right to portability. Individuals may also define directives relating to the storage, deletion and communication of their personal data after their death.

Individuals may, on grounds relating to their particular situation, object to the processing of data concerning them.

Any person who is the victim of a breach of one of the aforementioned rights may lodge a complaint with the CNIL (https://www.cnil.fr/).
