Scope of Application:
These General Terms and Conditions of Sale (GTCS) apply, without restriction or reservation, to any camping accommodation or pitch rental at Camping La Clémentine, for non-professional clients, via the website www.camping-clementine.fr
, by phone at 04 66 86 52 69, by mail at Camping La Clémentine, 1313 Route de la Baume, 30480 CENDRAS, or by email at contact@camping-clementine.fr
, or whenever the provider markets its services. These do not apply to long-term rentals of mobile homes, which require a separate long-term rental contract.
The main characteristics of the services are presented on the site www.camping-clementine.fr
or in written form (paper or electronic) if the reservation is not made online. The Client is obliged to read them before finalizing a reservation. The selection and purchase of a service are the sole responsibility of the client.
The Client declares that they have read these General Terms and Conditions of Sale and accepted them before making the online reservation, as well as the site's general terms of use at www.camping-clementine.fr
. If the reservation is not made online, acceptance is by any other appropriate means.
Reservation Conditions:
The reservation of a stay implies acceptance of our terms of sale as well as the internal rules of the campsite. The reservation request is in the name of a specific person. It must be made by an adult who is present throughout the stay. Minors must be accompanied by their parents or legal guardians. Full name, first name, and ages of participants must be communicated by the day of arrival at the latest. Any modification of the reservation must be notified in writing.
A reservation becomes effective only after receipt of the deposit and booking fees, and acceptance of the terms of sale at the time of online reservation, plus confirmation of reservation by our services via email (confirmation email). We are only bound by reservations that we accept, which we remain free to do or refuse, depending on availability.
We offer family stays, in the traditional sense; the accommodations are specially designed for that purpose. We reserve the right to refuse any reservation that is contrary to this principle or that seeks to circumvent it. Therefore, a pitch reservation or rental is strictly for personal use. You may under no circumstances sublet or transfer your reservation without our prior consent. Only one family (same name, same address) is permitted per pitch. If several families take turns on the same pitch, a reservation must be made for each family.
The camper is responsible for supervising personal belongings (bicycles, etc.). The campsite declines all responsibility for incidents falling under the camper's civil liability. All clients must comply with the campsite's internal rules. Each official tenant is responsible for disturbances or nuisances caused by people staying with them or visiting.
Arrivals and Departures:
In low season, arrival and departure days are flexible. In high season: arrivals and departures are possible on Wednesdays, Saturdays and Sundays, for a minimum of 7 nights for rentals and individual sanitary units. For camping pitches, arrival and departure days are flexible.
For camping pitches: arrival possible from 12:00, departures must be before 12:00. For rental accommodations and luxury pitches: arrivals are from 17:00, departures before 10:00.
Late Arrivals:
If arriving later than scheduled or leaving earlier than scheduled, relative to the dates on your booking confirmation, the full stay remains payable. You will not be entitled to any refund for the portion of the stay not used. If you do not show up and no message or proof is given, the rental becomes available on the next day at 12:00 after the arrival date foreseen in the contract; full payment of the services remains required.
Camping Pitch:
The basic package includes: a pitch for a tent, caravan or motorhome with electricity; accommodation for 2 people; space for 1 vehicle (to be parked on the pitch); access to sanitary facilities and wastewater discharge.
For infrastructure and safety reasons, our campsite is not adapted to twin-axle motorhomes and caravans. Consequently, motorhomes and caravans with two rear axles (twin-axle) are not permitted on site. We ask our clients to check their vehicle's characteristics before making any reservation. In case of non-compliance with this restriction, access to the campsite may be refused without refund. Motorhomes and caravans with a total length exceeding 7 meters must contact the reservation service prior to booking to verify compatibility with our pitches and infrastructure. If no prior contact is made, the campsite reserves the right to refuse access to the vehicle concerned, without any refund.
A maximum of 6 people are allowed per pitch. On departure day, pitches must be vacated no later than 12:00. Overtime will result in charging for an additional night. Your pitch must be left clean and free of rubbish.
Rental Accommodations:
The basic package includes: rental accommodations are fully equipped with kitchen utensils, dishes, furniture, blankets, pillows. Capacity for 2 to 8 people (including babies and children), depending on the accommodation rented. We reserve the right to refuse access to the campsite for groups or families exceeding the capacity of the rented accommodation. Access to entertainment, services, and leisure equipment is included. Sheets are not provided; you may rent them at reception with reservation. You may also rent a baby bed and a high chair for an extra fee. All rentals are strictly non-smoking.
Security Deposit:
A deposit of €300 will be required upon arrival; you must check inventory and report any anomaly within 24 hours. After this time, no claim will be taken into consideration. The accommodation must be returned clean and furniture/inventory will be checked; any item broken or damaged will be charged to you, as well as any necessary restoration of the property. The deposit will be released at end of stay, minus any deductions for damages based on invoices. Retaining the deposit does not preclude further compensation if costs exceed its amount. If accommodation has not been cleaned before departure, a cleaning fee of between €69 and €114 including VAT (depending on the accommodation) will be charged. For late departure, an extra day may be charged at the current nightly rate.
Group Reservations:
Any reservation of more than 4 accommodations by the same natural person, or by different persons who know each other and travel together for the same dates and purposes is considered a group. For group bookings, you must contact us by phone or email to discuss the reservation before acceptance or refusal.
Prices and Payment Terms:
Prices:
The services offered by the Provider are supplied at rates valid on www.camping-clementine.fr
or on any informational medium provided during the reservation. Prices are in Euros, with or without value-added tax. Prices take into account any discounts that may be offered by the Provider on the website or on any informational or communication materials. These prices are final and cannot be revised during their validity period as shown on the site, in emails, or in written proposals to the Client. Beyond that period, the offer expires and the Provider is no longer bound by the prices. They do not include processing and management fees, which are invoiced separately under conditions specified on the site or in prior communications to the Client; these are calculated before the reservation is made. The Client must pay the total price, including these fees. An invoice will be issued by the Seller and given to the Client no later than the balance payment due date.
Tourism Tax / Eco-contribution:
The tourist tax, collected on behalf of the municipality/council, is not included in the prices. Its amount is determined per person per day and varies depending on the destination.
Payment Conditions:
For reservations made more than 30 days before the start of the stay, a deposit of 35% of the cost of the reserved services must be paid at booking (within 10 days). The balance must be paid no later than 30 days before the start date of the stay. For reservations made less than 30 days before the start of the stay, full payment must be made at time of booking.
If the deposit is not paid at booking (within 10 days) or the balance is not paid at least 30 days before the start date, the Provider reserves the right to cancel the reservation and re-rent the accommodation.
Accepted payment methods: bank card, cash, checks (payable to Camping La Clémentine), bank transfers, and holiday vouchers (ANCV).
Promotions and Discounts:
Any discount that may apply is not cumulative with other promotional offers. It will only apply for a consecutive stay on the same pitch or in the same rental, and only for people present for the entire stay. Discounts and promotions in effect are not cumulative with those generated by ACSI / ANWB / ADAC cards.
Cancellations and Modifications:
Modification of your reservation:
The client may request modification of their stay (dates, type of accommodation) in writing (mail or email), depending on availability. No deferral will be accepted for the next season. If no modification, the client must stay under the original booking terms or cancel.
Any request to increase the length of stay will be honored subject to availability and current rates. Any request to reduce the duration of your stay is considered a partial cancellation and will be subject to the cancellation rules.
Cancellation of your stay without Cancellation Guarantee:
Any cancellation must be in writing (registered letter with acknowledgment of receipt or by email) to the establishment. Proof will be required. Cancellation by the client leads to variable charges depending on when it occurs:
More than 60 days before the start of the stay: Refund of the deposit paid, minus booking fees (€19) and any cancellation guarantee (3.5% of total stay amount, excluding booking fees)
Between 60 and 15 days before start date: Entire deposit is charged
Less than 15 days before the start date: Full amount of stay charged
A stay postponement will always be offered subject to our availability. If client refuses, above conditions apply. “Comfort” reasons (for example bad weather) are not accepted. A complementary guarantee allowing reimbursement of the stay in case of cancellation under certain conditions may be offered by the establishment.
Cancellation Guarantee:
This guarantee takes effect upon subscription of the rental contract and expires the day before the first day of stay at midnight. Subject to contractual obligations, this guarantee allows you to obtain reimbursement of amounts paid (booking fees and guarantee subscription deducted) if your stay must be cancelled for any of the following agreed reasons:
Serious illness, bodily injury or death of yourself, your legal or de facto spouse, your ascendants or descendants, guardian, brothers/sisters, brothers/sisters in law, children in law, parents in law.
By “serious illness or bodily injury” we mean any temporary or permanent impairment of your physical integrity, medically documented, and requiring cessation of any professional or other activity.
Pregnancy complications.
Serious damage: requiring your presence on the scheduled departure day, resulting from theft, fire, water damage or natural elements affecting your main residence or professional premises destroyed by more than 50% (insurer's certificate required).
Economic redundancy of yourself or spouse, provided procedure was not initiated before booking.
Refusal or change of leave (vacation) by your employer.
COVID-19: Free cancellation and reimbursement up to arrival day in cases such as: client or a member of their party testing positive for COVID on start date / quarantine due to positive test or confirmed contact / hospitalization of client or family member due to COVID / authorities requisition related to COVID. “Mass risk” reasons are excluded (generalized quarantine and lockdown, state of emergency health, border closures, administrative closure of establishment, denial of access to destination country if vaccine required and it was required at time of booking). All these reasons must be communicated by registered letter accompanied by all necessary documents proving the event (insurance report, police report, medical certificate, employer's letter, etc.) at latest within three working days following the incident or event.
No Right of Withdrawal:
In accordance with Article L.221‑28 of the French Consumer Code, we inform you that the sale of accommodation services provided on a set date, or repeating periodicity, is not subject to the 14‑day withdrawal period.
Barbecue:
Only electric or gas barbecues are permitted on the campsite.
Visitors:
Visitors are allowed under host's responsibility after registering their identity at reception upon arrival, regardless of time spent on the campsite. Parking for visitors is permitted only in the welcome entrance parking. Any person not declared at reception will be immediately expelled along with their host, without notice and without refund. Visitors have access to campsite facilities except aquatic areas and the lagoon.
Animals:
We accept animals for an extra charge, provided basic hygiene rules are respected. Animals must be kept on a leash and are not allowed in pools, sports fields, and children's play areas. They must be vaccinated (with up‑to‑date vaccination record) and never left alone in the rental or on the pitch. Category 1 and 2 dogs are prohibited in the campsite.
Children / Play / Sports Areas:
Children remain under supervision of parents in all play and sports facilities.
Aquatic Areas Rules:
Warning: aquatic areas are not supervised (pools and lagoon). It is strictly forbidden to dive into pools. Aquatic areas are reserved for campers. Minors must be accompanied by an adult inside the pool fencing, and may under no circumstances swim alone. Shower is mandatory. Persons who fail to comply with posted rules will be expelled from the pool, and the campsite if they refuse to abide by established rules displayed at each pool entrance.
Wristbands:
Wearing the identification wristband is mandatory throughout your stay across the entire campsite and in all its facilities. Without a wristband, access to our various services will be refused.
Traffic / Noise:
Speed is limited to 10 km/h. Pedestrians and cyclists have priority throughout the campsite. Parking is forbidden in alleys and access roads; it must be on your rented plot, not on neighboring plots even if free. Gates are closed from 11:00 pm to 6:00 am, during which time motorized traffic is forbidden. In case of late arrival, parking must be done in the guest parking at the campsite entrance. Use of sound‑making devices must not disturb others. Noise should not disrupt the tranquility of campers. Honking is strictly prohibited.
Contract Termination:
Failure to comply with even one clause of this contract may lead to automatic termination by the manager.
Insurance / Civil Liability:
It is the responsibility of campers/caravan owners to take out insurance for their caravan, tent, and equipment to cover risks of theft, fire, water damage, civil liability, third‑party claims. Management declines all responsibility in case of theft, loss or damage due to bad weather or accidents occurring within the campsite, on car parks, pitches or common areas. No liability may be attributed to the campsite in case of injuries, illness or death of clients caused by sports activities or others.
Internal Rules of the Campsite:
Every camper must comply with the internal rules. Every person staying at the campsite must be declared at the time of reservation. Management reserves the right to expel without notice or refund any persons violating the internal rules, or who have not declared all occupants or who have given false information concerning occupants of the pitch or rental.
Right to Image / Publicity:
You authorize Camping La Clémentine, and anyone we may appoint, to photograph, record or film you during your stay and to use those images, sounds, videos and recordings on any medium (particularly the website and social networks), as well as all promotional and presentation media of the campsite. This authorization applies both to you and to persons accommodated with you. Its sole purpose is to ensure the promotion and animation of the establishment, and it shall not in any way damage your reputation. This authorization is granted free of charge for all countries and for a period of 5 years.
Consumer Dispute Mediation:
In accordance with Article L.161‑2‑1 of the Consumer Code, any client of the campsite has the right to use a consumer mediator free of charge to settle amicably any dispute they may have with the campsite operator. The contact details of the consumer mediator the client may contact are as follows:
